These Terms of Service ("Terms") govern your use of applabscorp.com and, where applicable, services supplied by Applabs Corp ("Company", "we", "our" or "us").

By using this website, you agree to these Terms. If you do not agree with them, you should discontinue use of the website.

Our Services

Applabs Corp may provide digital services including web development, website design, search engine optimisation, digital marketing, advertising, branding, graphic design, website maintenance, technical services and related consulting.

The precise scope, deliverables, timetable and price of client work may be set out separately in a quotation, proposal, invoice, statement of work or other written agreement.

Where a specific written agreement conflicts with these general website Terms regarding a particular project, the specific written agreement will normally govern that project to the extent of the conflict.

Quotations and Project Scope

Quotations are based on the information and requirements available when the quotation is prepared.

Work requested outside the agreed scope may require an additional quotation, revised price or revised delivery schedule.

Estimates concerning timelines are subject to reasonable changes where delays arise from client feedback, third-party services, technical problems, changing requirements or circumstances outside our reasonable control.

Client Responsibilities

Where necessary to perform services, clients are responsible for providing accurate information, content, approvals, credentials and other materials within a reasonable timeframe.

Clients represent that they have the necessary rights or permissions to provide any text, images, logos, trademarks, software, data or other materials supplied to Applabs Corp for use in a project.

Delays in receiving required materials, information or approvals may affect project delivery dates.

Prices and Payments

Prices, deposits, instalments and payment deadlines may be specified in the relevant quotation, invoice, order page, proposal or project agreement.

Where a payment provider is used, your transaction may also be subject to that provider's terms and privacy policy.

We may postpone, suspend or withhold work or delivery where an amount that is properly due remains unpaid, subject to the terms of the relevant agreement and applicable law.

Cancellations and Refunds

Eligibility for cancellation or refund depends on the service purchased, work already completed, third-party costs incurred, project stage and any specific terms agreed with the client.

Because many of our services involve customised professional work, a full refund may not be available once work has begun or costs have been incurred.

Any specific cancellation or refund terms shown in a quotation, proposal, order or contract will apply to that service, subject to rights that cannot lawfully be excluded.

Intellectual Property

Unless otherwise agreed, the Applabs Corp website, its original design, branding, text, graphics, software and other original content are owned by or licensed to Applabs Corp and are protected by applicable intellectual-property laws.

Ownership and licensing arrangements for project-specific deliverables may be defined in the relevant quotation, proposal, invoice or contract.

Third-party software, fonts, plugins, images, themes, libraries and other licensed materials remain subject to the terms imposed by their respective owners or licensors.

Client Materials

Clients retain their rights in original materials they supply to us.

By supplying such materials for a project, the client gives Applabs Corp the permission reasonably necessary to reproduce, modify, process or otherwise use those materials for the purpose of performing the agreed services.

Portfolio and Project References

Unless confidentiality requirements or a separate agreement prevent us from doing so, we may request permission to identify completed work in our portfolio or marketing materials. Where a client has expressly requested confidentiality, we will respect the applicable agreement.

Acceptable Use

You must not use our website to:

  • Violate applicable law.
  • Attempt to gain unauthorised access to systems, accounts or data.
  • Introduce viruses, malicious code or other harmful technologies.
  • Interfere with the security, operation or availability of the website.
  • Use automated systems in a manner that places unreasonable load on our infrastructure.
  • Misrepresent your identity or affiliation.
  • Use our website to infringe the rights of another person or organisation.

Third-Party Services

Our website and client projects may depend on third-party services such as hosting providers, domain registrars, search engines, advertising platforms, social networks, payment processors, analytics services, software providers and content-management systems.

Such services are operated independently and may change their functionality, pricing, policies, availability or technical requirements.

Unless otherwise agreed, Applabs Corp is not responsible for outages, changes or actions caused solely by an independent third-party service outside our reasonable control.

SEO, Advertising and Marketing Results

Search rankings, traffic, advertising performance, sales, leads and other marketing outcomes depend on numerous factors that cannot be completely controlled by Applabs Corp.

These may include search-engine algorithms, advertising-platform policies, competition, market demand, pricing, website history, customer behaviour, budgets and third-party decisions.

No guaranteed rankings

Unless expressly agreed otherwise in writing, we do not guarantee a particular search-engine ranking, number of leads, amount of revenue, return on advertising spend or other specific commercial result.

Disclaimer of Warranties

To the extent permitted by applicable law, the public website is provided on an "as is" and "as available" basis.

We do not warrant that the website will always be uninterrupted, completely error-free or free from every harmful component.

Nothing in these Terms excludes warranties, rights or remedies that cannot lawfully be excluded.

Limitation of Liability

To the extent permitted by applicable law, Applabs Corp will not be responsible for indirect, incidental, special or consequential loss arising solely from use of the public website.

Liability relating to paid client services may also be governed by the specific quotation, proposal, contract or statement of work applying to those services.

Nothing in these Terms is intended to exclude or restrict liability where such exclusion or restriction would be unlawful.

Suspension and Termination

We may restrict access to our website where reasonably necessary to protect our systems, investigate misuse, comply with law or respond to a breach of these Terms. The termination of a paid client engagement will be governed by any applicable project agreement in addition to applicable law.

Governing Law

These general Terms are governed by the laws of Mauritius, subject to any mandatory legal rights or jurisdictional rules that apply.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

We may update these Terms periodically. Updated Terms become effective when published on this page unless otherwise stated. The date at the top of the page identifies the most recent revision.
